These Terms & Conditions govern the use of the website artofholidays-mauritius.com and the services provided by Art of Holidays Mauritius. By using our website or booking with us, you agree to be bound by these Terms.
Definitions
- "We", "us", "our" refers to [NOM_ENTITE_LEGALE], trading as Art of Holidays Mauritius.
- "You", "your", "client", "traveller" refers to any person using our website or booking our services.
- "Services" refers to all travel-related services offered by Art of Holidays, including itinerary design, hotel bookings, transfers, tours and tailor-made packages.
Booking process
All bookings are made by direct contact with our team via email, WhatsApp or our online form. A booking is considered confirmed only after:
- You have received our written quote and accepted it
- The required deposit has been received
- We have confirmed availability with our partners
Until then, all proposals are non-binding and subject to availability.
Pricing & payment
Prices are quoted in [DEVISE_PRINCIPALE] and may include or exclude certain elements as detailed in your individual quote.
Deposit and balance
- Deposit: [POURCENTAGE_ACOMPTE]% of the total amount, payable upon booking confirmation
- Balance: due [DELAI_PAIEMENT_SOLDE] before the start of the trip
- Bookings made within [DELAI_DERNIERE_MINUTE] of departure: full payment required
Accepted payment methods: [METHODES_PAIEMENT]. Any bank fees are at the client's expense.
Cancellation by the client
If you need to cancel your booking, the following fees apply (calculated on the total trip amount):
- More than 60 days before departure: [POURCENTAGE_FRAIS]% retained
- Between 60 and 30 days: [POURCENTAGE_FRAIS]% retained
- Between 30 and 15 days: [POURCENTAGE_FRAIS]% retained
- Less than 15 days or no-show: 100% retained
Cancellation must be sent in writing to reservation@artofholidays-mauritius.com. The cancellation date is the date we receive your notification.
We strongly recommend taking out travel insurance covering cancellation, repatriation and luggage.
Cancellation by us
In exceptional cases (force majeure, political instability, natural disaster, partner failure), we may have to modify or cancel a booking. In such case, we will:
- Inform you as soon as possible
- Propose an alternative trip of equivalent quality
- Refund all amounts paid if no alternative is acceptable to you
Modifications
Any change requested by the client after booking confirmation is subject to availability and may incur additional fees, depending on our partners' policies.
Some elements of the trip (flights, transfers, restaurants) may be slightly adjusted by Art of Holidays for operational reasons, while preserving the overall quality of the experience.
Travel documents & responsibilities
It is the client's sole responsibility to ensure that all travel documents are valid, including:
- Valid passport (at least 6 months after the return date)
- Visas required for the destinations visited
- Vaccinations and health certificates if needed
- Valid travel insurance
Art of Holidays cannot be held liable for travel disruptions caused by missing or invalid documents.
Liability
Art of Holidays acts as an intermediary between travellers and service providers (hotels, airlines, transfer companies, tour operators). We are committed to selecting reliable, quality partners.
However, we cannot be held liable for:
- Faults or negligence by third-party service providers
- Force majeure events
- Personal accidents, illness or theft during the trip
- Schedule changes or cancellations by airlines
Our liability is in any case limited to the amount paid by the client for the relevant trip.
Complaints
For any complaint during your trip, please contact us immediately so we can find a quick solution.
For any post-trip complaint, please send a written claim to reservation@artofholidays-mauritius.com within 30 days of returning. We will respond within 30 days of receipt.
Personal data
The processing of your personal data is governed by our Privacy Policy, available on this website.
Applicable law & jurisdiction
These Terms & Conditions are governed by the laws of the Republic of Mauritius. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts in Mauritius.
Changes to these Terms
We reserve the right to modify these Terms & Conditions at any time. The applicable version is the one in force at the time of your booking.
